GENERAL TERMS AND CONDITIONS (GTC)

1. Scope

These General Terms and Conditions apply to the use of this website and to any real estate brokerage and advisory services agreed between Catrotec  Real Estate and its clients.

2. Non-Binding Enquiries

Submitting an enquiry through the contact form, by email or by telephone is non-binding and does not constitute the conclusion of a brokerage agreement. A brokerage agreement is concluded only through a separate agreement in text form.

3. Property Listings

All property information is based on details provided by owners, sellers or other third parties. Despite careful review, no guarantee can be given as to the completeness, accuracy or current validity of such information.

All property listings are subject to prior sale, prior letting and modification.

4. Brokerage Commission

A brokerage commission is payable only if it has been expressly agreed in advance and a legally effective purchase, rental or other principal agreement is concluded as a result of the broker's introduction or brokerage services.

The applicable commission amount will be stated in the respective property listing or in a separate brokerage agreement. Any mandatory statutory provisions governing the allocation of brokerage costs remain unaffected.

5. Client Obligations

The client is required to provide all information necessary for the brokerage or advisory services completely and truthfully. The client must promptly disclose any property listings already known to them or any existing contacts with owners or prospective buyers or tenants.

Confidential property information and property particulars may be disclosed to third parties only with prior consent.

6. Liability

Catrotec  Real Estate shall have unlimited liability in cases of intent or gross negligence and for damages arising from injury to life, limb or health.

In cases involving the slightly negligent breach of material contractual obligations, liability shall be limited to the foreseeable loss or damage typically associated with the type of contract concerned. Liability for information provided by third parties is excluded unless Catrotec  Real Estate has acted intentionally or with gross negligence.

7. Copyright

The texts, photographs, property particulars and other content published on this website may not be reproduced, modified, published or used for commercial purposes without prior consent.

8. Final Provisions

The laws of the Federal Republic of Germany shall apply. Mandatory statutory consumer-protection provisions remain unaffected.

Where the client is a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, Bielefeld shall be the agreed place of jurisdiction to the extent permitted by law.

Should any individual provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The relevant statutory provisions shall apply in place of the invalid provision.

We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.

In the event of any discrepancies between the German and English versions, the German version shall prevail.
